The ex-lawyer for the former president has resigned as the chief federal prosecutor in the state. This comes after a judicial decision that questioned her legal standing to occupy the role.
Attorney General's Statement
US Attorney General, Pam Bondi, confirmed the prosecutor's departure on the start of the week. Bondi stated that the judicial decision made it "untenable" for Habba to perform her duties.
"Do not interpret compliance for surrender," she wrote. "My fight will now reach across the country."

The departure was triggered by a federal appellate panel determined that she had been serving in violation of the law as US attorney. This ruling is likely to affect numerous criminal cases in the state.
The court said that a interim role that bypassed confirmation by the US Senate breached the Federal Vacancies Reform Act.

It was also stated that Habba will remain at the justice department as a top consultant. They intend to seek further review of the ruling, in the hope of achieving a reversal.
On a social media platform, Bondi argued that the judiciary "must not override the President's choice of prosecutors entrusted with executing the executive branch's core responsibility of prosecuting crime."

Habba, first joined Donald Trump's lawyers in 2021. She later represented the former president in his New York criminal case in 2024, leading to his conviction on 34 counts of falsifying business records.
Prior to assuming the top New Jersey post, the former president had announced he was selecting her as his presidential counsellor during his second administration, describing Habba as a steadfast ally and a relentless legal advocate.
