Federal Judge Mandates Freedom of Kilmar Abrego Garcia from ICE Detention

A court has ordered the immediate release of Kilmar Abrego Garcia from immigration custody, finding his ongoing confinement is without legal authority.

"Since his release after wrongful imprisonment in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis wrote in her order.

The situation stems from a erroneous removal to El Salvador earlier this year, which US authorities later acknowledged was an mistake. After his repatriation to the United States to answer alien smuggling allegations, he was detained in federal detention.

In her order, the judge noted that the authorities does not have a valid removal order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."

Context of the Legal Challenge

The court proceedings center on conflicting claims. Whereas the former administration contends that Abrego Garcia is a member of the MS-13 gang, he vehemently denies this claim.

He has also entered a not guilty plea to the conspiracy charges, which are part of a ongoing criminal case in the state of Tennessee.

The court, who was hearing his petition to deportation in a Maryland district court, determined that he must now adhere to the conditions of his bond from jail in Tennessee. This decision effectively transfers his monitoring to the Tennessee court.
